२०२१-२२ शैक्षणिक वर्षासाठी १५ टक्के फी कपात करण्याचा शासन निर्णय जाहीर

कोव्हीड -१९ या महामारीच्या पार्श्वभुमीवर संपूर्ण देशात दिनांक २४ मार्च २०२० पासुन लॉकडाऊन लागु करण्यात आल्यामुळे त्याचा सामाजिक व आर्थिक पातळीवर मोठा प्रतिकुल परिणाम झाला आहे, या मुळे अर्थव्यवस्था मोडकळीस आली असून अनेक पालक त्यांच्या स्वयंअर्थसहाय्यीत खाजगी शाळेत शिकणाऱ्या पाल्यांची फी भरण्याच्या स्थितीत नाहीत त्यामुळे या असाधारण परिस्थितीत शाळेची “फी” कमी करण्याबाबत/माफ करण्याबाबत अनेक पालकांची निवेदने शासनास प्राप्त झाली आहेत.

मा. सर्वोच्च न्यायालयात दाखल सिव्हील अपील क्र.१७२४/२०२१, इंडियन स्कूल जोधपूर विरुध्द राजस्थान राज्य या न्यायालयीन प्रकरणी मा. सर्वोच्च न्यायालयाने दिनांक ०३ मे २०२१ रोजी खालील प्रमाणे आदेश पारीत केले आहेत:

116. As aforesaid, we would assume that the least 15 percent of the annual school fees would be towards overheads/expenses saved by the school Management. Arguendo, this assumption is on the higher side than the actual savings by the school management of private unaided schools, yet we are inclined to fix that percentage because the educational institutions are engaged in doing charitable activity of imparting and spreading education and not make money. That they must willingly and proactively do. Hence, collection of commensurate amount (15 percent of the annual school fees for academic year 2020-2021), would be a case of profiteering and commercialisation by the school Management.

117. Ordinarily, we would have thought it appropriate to relegate the parties before the Regulatory Authority to refix the school fees for the academic year 2020-21 after taking into account all aspects of the matter including the advantage gained by the school Management due to unspent overheads/expenses in respect of facilities not availed by the students. However, that course can be obviated by the arrangement that we propose to direct in terms of this judgement. To avoid multiplicity of proceedings (as school fee structure is linked to school- school wise) including uncertainty of legal processes by over 36,000 schools in determination of annual fee structure for the academic year 2020-21, as one-time measure to do complete justice between the parties, we propose to issue following directions:

1. The appellants (School Management of the concerned private unaided school) shall collect annual school fees from their students as fixed under the Act of 2016 for the academic year 2019-20 but by providing deduction of 15 percent on the amount in lieu of unutilised facilities by the students during the relevant period of academic year 2020-21.

2. The amount so payable by the concerned students be paid in six equal monthly installments before 05.08.2021 as noted in our order dated 08.02.2021.

3. Regardless of the above, it will be open to the appellants (concerned schools) to give further concession to their students or to evolve a different pattern for giving concession over and above those noted in clauses (i) and (ii) above.

4. The school Management shall not debar any student from attending either online classes or physical classes on account of non-payment of fees. arrears/outstanding fees including the installments,referred to above, and shall not withhold the result of the examinations of any student on that account.

5. If any individual request is made by the parent/ward finding it difficult to remit annual fees for the academic year 2020-21 in the above terms, the school Management to consider such representation on case-to-case basis sympathetically.

6. The above arrangement will not affect collection of fees for the academic year 2021-22, as is payable by the students of the concerned school as and when it becomes due and payable.

7. The school management shall not withhold the name of any student/candidate for the ensuing Board examinations for classes X and XII on the ground of non-payment of feel arrears for the academic year 2020-21, if any, on obtaining undertaking of the concerned parents/students.

118. We are conscious of the fact that we are issuing general uniform direction of deduction of 15 per cent of the annual school fees in lieu of unutilized facilities/activities and not on the basis of actual data school- wise. As aforesaid, we have chosen to do so with a view to obviate avoidable litigation and to give finality to the issue of determination and collection of school fees for the academic year 2020-21, as a one-time measure which is the subject matter of these appeals. We have consciously limited the quantum of deduction from annual school fees to 15 per cent although the school Management had mentioned about its willingness to provide 25 per cent scholarship to deserving students, as we have compelled the school Management to collect annual school fees for the academic year 2020-21 as was fixed for the academic year 2019-20 on which some of the school Management (s) could have legitimately asked for increase of at least 10 percent in terms of Section 6 (5) of the Act of 2016.

शैक्षणिक वर्ष २०२०-२१ विद्यार्थ्यांच्या काही पालकांनी, या अधिनियमान्वये मान्यता दिलेल्या शाळेच्या शुल्क संरचनेनुसार, शुल्क प्रदान केलेले आहे. तथापि, राज्यात दि. २४ मार्च २०२० पासून कोव्हीड १९ या सार्वत्रिक साथरोगाच्या प्रादुर्भावामुळे आणि या साथरोगाचे नियंत्रण करण्यासाठी शासनाने टाळेबंदी घोषित केल्यामुळे बहुतांश कालावधीसाठी शाळा बंद होत्या. तसेच प्रवासावर किंवा येण्याजाण्यावर देखील निर्बंध होते. परीणामी, या सार्वत्रिक साथरोगामुळे निर्माण झालेल्या परिस्थितीमुळे विद्यार्थ्यांना प्रत्यक्षपणे शाळेत उपस्थित राहता येऊ शकले नाही आणि ज्या विवक्षित शैक्षणिक सुविधांसाठी शुल्क आकारले गेले होते आणि काही प्रकरणामध्ये असे शुल्क प्रदान केले होते, त्या शैक्षणिक सुविधांचा वापर झाला नाही. शाळांनी वर्ग देखील ऑनलाईन किंवा आभासी अध्ययन किंवा ई – अध्ययन पध्दतीने घेतले होते. शैक्षणिक सुविधांचा लाभ घेणे किंवा वापर करणे विद्यार्थ्यांना शक्य झालेले नसतांना शुल्क आकारणे ही बाब, शिक्षणाच्या नफेखोरीमध्ये किंवा व्यापारीकरणात मोडत असून सुप्रस्थापित कायदयाने त्यास स्पष्टपणे मनाई केलेली आहे.

दुसऱ्या बाजूला कोव्हीड १९ महामारीच्या पार्श्वभुमीवर अनेकांना आपले रोजगार गमवावे लागले आहेत व मोठया प्रमाणात व्यवसायावर देखील प्रतिकूल परीणाम झालेला आहे या सर्व परिस्थितीमुळे पालकांची आर्थिक स्थिती खराब झाली असून अनेक पालक शाळांची संपूर्ण फी (१०० टक्के) भरण्याच्या परिस्थितीत नाही त्यामुळे ज्या शैक्षणिक सोयी सुविधांचा वापर करण्यात आलेला नाही त्यासाठी घेण्यात येणारे शुल्क कमी करण्याबाबत अनेक पालक/पालक संघटनांची निवेदने शासनास प्राप्त झालेली आहे.

मा . सर्वोच्च न्यायालयाने विशेष अनुमती याचिका डायरी क्र. १५४१७/२०२१ , जयश्री सुनिल देशपांडे व इतर विरुध्द महाराष्ट्र शासन व इतर या न्यायालयीन प्रकरणी दिनांक २२ जुलै २०२१ रोजी खालील प्रमाणे आदेश पारीत केले आहे.

If the petitioners so desire , they are free to take recourse thereto before the competent authority . That may be answered by the competent authority appropriately and in accordance with law , including by keeping in mind the dictum of this Court in Indian school , Jodhpur Vs. State of Rajasthan reported in 2021 SCC online SC 359 .

कोव्हीड -१९ च्या पार्श्वभुमीवर विविध शैक्षणिक शुल्कांमध्ये विद्यार्थ्यांना सवलत देण्यासंदर्भात उच्च व तंत्र शिक्षण विभागाने त्यांचे पत्र क्र. बैठक -२०२१ /प्र.क्र .१३७/वि.शि -३, दि.३० जून २०२१ अन्वये सर्व अकृषिक विद्यापिठांच्या कुलगुरुंना निर्णय घेण्याबाबत कळविले आहे. तसेच कृषी विभागाने देखील त्यांचे पत्र क्र. मकृप -१०२१/प्र.क्र.१०७/७ अ, दि.२२ जुलै २०२१ अन्वये राज्यातील सर्व कृषी विद्यापीठांच्या कुलगुरुंना कोव्हीड -१९ च्या पार्श्वभुमीवर विद्यार्थ्यांना विविध शैक्षणिक शुल्कांमध्ये सवलत देण्यासंदर्भात निर्णय घेण्याबाबत कळविले आहे. यामध्ये प्रामुख्याने ज्या बाबींवर कोणत्याही प्रकारचा खर्च करण्यात आलेला नाही त्यासाठी आकारण्यात येणारे संपूर्ण शुल्क माफ करण्यात यावे, प्रयोगशाळा, ग्रंथालय, जिमखाना, खेळ व इतर उपक्रम या बाबतच्या शुल्कामध्ये ५० टक्के सवलत देण्यात यावी, विकास शुल्कांत ५० टक्के सूट देण्यात यावी इ. बाबत कळविले आहे.

कोव्हीड -१९ या सार्वत्रिक साथरोगाचा प्रादुर्भाव अजूनही सुरु आहे आणि शाळांनी अदयाप नेहमीच्या प्रत्यक्ष पध्दतीने कामकाज सुरु केलेले नाही. तसेच अनेक शाळामध्ये कार्यकारी समित्या गठीत करण्यात आलेल्या नाहीत. राज्यातील खाजगी शाळांची मोठी संख्या विचारात घेता शाळा निहाय न वापरलेल्या शैक्षणिक सोयी सुविधांकरीता प्रत्येक शाळेची किती बचत झाली आहे याची गणना करणे व्यवहारीक दृष्टया शक्य नसल्यामुळे तसेच यासाठी बराच कालावधी लागण्याची शक्यता विचारात घेता, प्राप्त परिस्थितीत पालकांना तातडीने काही प्रमाणात शैक्षणिक शुल्काबाबत दिलासा देणे आवश्यक आहे त्यामुळे एकवेळची बाब म्हणून मा.सर्वोच्च न्यायालयाने फी कपातीबाबत घेतलेल्या निर्णयाचा आधार घेऊन शैक्षणिक वर्ष २०२१-२२ या शैक्षणिक वर्षात एकूण निश्चित करण्यात आलेल्या फी च्या १५ टक्के कपात करण्याचे प्रस्तावित आहे.

भारतीय संविधानाच्या अनुच्छेद १६२ नुसार ज्या बाबतीत राज्य विधीमंडळास कायदे करण्याचा अधिकार आहे, अशा बाबतीत राज्य शासनास कार्यकारी आदेश काढण्याचा अधिकार आहे.

राज्यात देखील बहुतांश भागात मार्च, २०२० पासून बऱ्याच कालावधीसाठी शाळा बंद असून विद्यार्थ्यांना ऑनलाईन शिक्षण देण्यात येत आहे यामुळे राज्यातील विद्यार्थ्यांनी देखील काही शैक्षणिक सुविधांचा वापर केलेला नाही व यामुळे शैक्षणिक संस्थेचा खर्चात देखील काही प्रमाणात बचत झाली आहे. उक्त नमुद पार्श्वभुमी व मा. सर्वोच्च न्यायालयाने वरीलप्रमाणे पारीत केलेले आदेश विचारात घेवून शासन पुढील प्रमाणे निर्णय घेतला आहे.

सन २०२१-२२ या शैक्षणिक वर्षासाठी एकवेळेची बाब म्हणून सर्व मंडळांच्या व सर्व माध्यमांच्या शाळांना खालील प्रमाणे निर्देश देण्यात येत आहेत:

१) सन २०२१-२२ या शैक्षणिक वर्षासाठी निश्चित करण्यात आलेल्या एकूण फी मध्ये १५ टक्के कपात करण्यात यावी.

२) यापूर्वी ज्या पालकांनी पूर्ण फी भरली आहे, अशी अतिरीक्त फी पुढील महिन्यात किंवा तिमाही हप्त्यांत किंवा पुढील वर्षी शाळा व्यवस्थापनाने समायोजित करावी किंवा याप्रमाणे फी समायोजित करणे शक्य नसल्यास फी परत करावी.

३) कपात करण्यात आलेल्या फी बाबत विवाद निर्माण झाल्यास असा विवाद यथास्थिती संबंधित विभागीय शुल्क नियामक समितीकडे किंवा शासन निर्णय क्र. तक्रार -२०२०/प्र.क्र.५०/एस.डी -४, दिनांक २६ फेब्रुवारी २०२० अन्वये गठीत विभागीय तक्रार निवारण समितीकडे दाखल करण्यात यावा व याबाबत विभागीय शुल्क नियामक समितीने किंवा विभागीय तक्रार निवारण समितीने घेतलेला निर्णय अंतिम राहील.

४) कोव्हीड -१९ महामारीच्या काळात विद्यार्थ्यांने शाळेची फी, थकीत फी भरली नाही म्हणून शाळा व्यवस्थापन अशा कोणत्याही विद्यार्थ्यांला प्रत्यक्ष अथवा ऑनलाईन पध्दतीने शिक्षण घेण्यास किंवा परीक्षेस बसण्यास प्रतिबंध करण्यात येऊ नये किंवा अशा विद्यार्थ्यांचा निकाल देखील रोखून धरण्यात येऊ नये.

वरील आदेश सर्व मंडळाच्या, सर्व माध्यमांच्या शाळांना लागू राहतील आणि हे आदेश तात्काळ परिणामाने अंमलात येतील.
